It all started when a man named Lu in China purchased four phones from an e-commerce platform. After using the phones, he wanted to return them within the seven-day unconditional return period. However, his return request was denied by the e-commerce platform.
Instead of giving up, Lu sold the phones on a second-hand platform at a lower price and then sued the platform to recover his losses, claiming, “I lost money; the platform should compensate me!” But things didn’t go as he expected in court.
Details revealed in court were shocking. Lu had placed 209 orders on this platform in the past six months, 106 of which were smartphones, and he had returned 77 of them. This is why the e-commerce platform rejected his return requests for the last four phones.
The court ruled that Lu had abused his right to return goods, violating the principle of good faith, and stated that the return policy should not be exploited in this manner. Thus, the court dismissed Lu’s case.
In Turkey, e-commerce platforms typically offer an unconditional return policy within 14 days. While return policies like this are a valuable service in many countries, it might not be wise to abuse them. This case serves as an important example for understanding the boundaries of consumer rights.
